Terms of Service
Effective date: January 20, 2026. By booking or using any ChimneySpark service, you agree to these Terms of Service. If you do not agree, please do not use our services.
Bookings
Appointments are confirmed via email or phone. You must ensure safe roof access where applicable.
Scheduling and Confirmation
When you request an appointment, we will provide a proposed date and time window. Your appointment is confirmed once you receive a confirmation message by email or phone. If we cannot reach you with the contact details provided, we may cancel or reschedule at our discretion.
Site Readiness and Access
- Provide unobstructed, safe access to the work area, including roof and interior spaces as needed.
- Ensure pets are secured and valuables are removed from the work area to prevent damage or interference.
- Disclose known hazards (asbestos, unstable structures, nests, creosote accumulation) prior to the appointment.
- Weather and safety conditions may require on-site adjustments or rescheduling.
- A responsible adult (18+) must be present to grant access and authorize work unless otherwise agreed in writing.
Pricing
Prices are displayed before checkout and exclude applicable taxes unless otherwise stated.
Estimates and Variations
- Online and phone estimates are non-binding and based on information you provide.
- Final pricing may change due to site conditions, additional materials, or code compliance requirements discovered on-site.
- Emergency and after-hours services may carry a surcharge disclosed before work begins whenever feasible.
- Unless indicated, disposal fees and permits are billed separately when applicable.
Payment Terms
Payment is due upon completion of work unless a written credit arrangement exists. We accept major cards and e-transfer. Invoices unpaid after 15 days may incur interest at the maximum rate permitted by law. You are responsible for bank or card fees charged by your provider.
Cancellations
Cancel at least 24 hours in advance to avoid a call-out fee.
Policy Details
- Cancellations made 24 hours or more before the appointment incur no fee.
- Cancellations within 24 hours or no access on arrival may incur a call-out fee up to CAD $89 plus taxes.
- Rescheduling due to severe weather or unsafe conditions is permitted without penalty at our discretion.
- If we are delayed by circumstances beyond our control, we will notify you promptly and offer the next available slot.
Liability
We are insured and take all reasonable precautions; however, we are not responsible for pre-existing structural issues.
Limits of Responsibility
- Our total liability for any claim is limited to the amount you paid for the specific service giving rise to the claim.
- We are not liable for indirect, incidental, special, punitive, or consequential damages, including loss of use, revenue, or profit.
- We are not responsible for damage arising from pre-existing defects, concealed conditions, or code violations.
- You agree to indemnify and hold us harmless from third-party claims resulting from your breach of these terms or misuse of the serviced system.
Warranties
We provide a limited workmanship warranty for 90 days from the service date unless otherwise specified in writing. This warranty does not cover normal wear, misuse, neglect, or failures caused by noncompliant installations by others.
User Obligations
You agree to provide accurate information, comply with safety guidance, and use services for lawful purposes only.
- Comply with applicable building codes, manufacturer instructions, and safety advisories.
- Promptly communicate any concerns about smoke, draft, or performance issues post-service.
- Do not tamper with or alter installed parts or safety devices without qualified assistance.
- Schedule regular inspections and maintenance as recommended to maintain safe operation.
Health and Safety
Your property must meet minimum safety standards for our technicians to perform work. We may refuse or stop work if conditions are unsafe. In such cases, you will only be charged for work performed to that point and reasonable costs incurred.
Service Reports and Photos
To document findings and compliance, we may produce a service report that can include photos. Reports are for your records and may be required by insurers. We do not publish or share your identifiable information without consent unless legally required.
Privacy
We process your personal information to deliver services and for legitimate business purposes in accordance with Canadian privacy laws. For details, contact [email protected].
Dispute Resolution
We aim to resolve issues amicably. Please contact us within 30 days of the service date to discuss any concern. If unresolved, disputes will be handled in accordance with the Governing Law section below.
Governing Law
These terms are governed by the laws of Ontario, Canada, without regard to conflict-of-laws principles. Venue for any proceeding shall be the provincial or federal courts located in Ontario.
Changes to These Terms
We may update these terms from time to time. Material changes take effect 14 days after posting unless a shorter period is required by law or for safety reasons. Your continued use after the effective date constitutes acceptance.
Severability and Entire Agreement
If any provision is found unenforceable, the remaining provisions remain in full force. These terms, together with your booking confirmation and any written work order, form the entire agreement between you and ChimneySpark regarding the services.
